By accessing or using MTH1W Math Mission ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to everyone who uses the Service, including students, teachers, and visitors who use optional guest preview (try-before-sign-in) access.
MTH1W Math Mission is an educational mathematics platform designed for use in educational settings. The Service provides:
The Service is operated by Timothy Calford, operating as CalfordMath ("we," "us," or "our").
Full use of the Service—including joining a class, viewing full progress and statistics as a registered student, purchasing a teacher subscription, and other account-based features—requires authentication using either a Microsoft account (through Microsoft Azure Active Directory) or a Google account (through Google OAuth). We may also offer limited guest preview access without signing in, as described in Section 3.4.
When you authenticate, you grant us permission to access your basic profile information (name and email address) as permitted by the authentication provider's permission scopes (Microsoft User.Read or Google profile/email scopes).

If you believe your account has been compromised, you should immediately secure your Microsoft or Google account through your authentication provider's security settings. While we cannot restore deleted progress or undo completed activities, securing your account will prevent further unauthorized access.
The Service supports two types of accounts:
We may allow you to use a guest preview mode to try the Service before you sign in. Guest preview is optional, limited, and does not create a registered student or teacher account.
Teacher accounts are available on an annual subscription basis. Subscriptions may be:
All payments are processed securely through Stripe, a third-party payment processor. We do not store, process, or have access to your credit card information. Payment processing is subject to Stripe's terms of service and privacy policy.
During testing and promotional periods, we may offer free teacher account memberships. These trial accounts are subject to the same Terms of Service as paid accounts, except that refund policies do not apply to trial accounts where no monetary exchange has occurred.
If you have selected an auto-recurring subscription, your subscription will automatically renew at the end of each annual period unless you cancel before the renewal date. You will be charged the then-current annual subscription fee.
You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. You will continue to have access to the Service until the end of your paid period.
If a teacher opts not to renew their subscription, their account will transition to an expired subscription status. Teachers with expired subscriptions retain certain read-only access to their historical data while losing the ability to make modifications or create new content.

If the Service becomes unusable for an unreasonable length of time due to our fault, we may, at our sole discretion, issue a refund for the current year's subscription. Refunds will not be issued for:
Refund requests must be submitted in writing and will be evaluated on a case-by-case basis. We reserve the right to determine what constitutes an "unreasonable length of time" for service disruption.

While the Service is designed to support learning and practice, you are expected to maintain academic integrity. Teachers may use classroom management features (such as pause/lock functionality) to prevent unauthorized assistance during assessments.
We collect and process information as described in our Privacy Statement. By using the Service, you consent to the collection and use of information in accordance with our Privacy Statement.

The Service includes two types of leaderboards:
Your individual opt-out setting applies to both class leaderboards and public leaderboards. If you opt out through your account settings, you will not appear in either type of leaderboard, regardless of your teacher's enable settings.
Note: Leaderboard participation is a privilege reserved for students enrolled in classes with teachers. Solo users and solo gameplay (play outside of a class context) are excluded from all leaderboards, as leaderboards are designed for classroom-based learning environments. Guest preview users are not enrolled in a class through the preview session and do not participate in class or public leaderboards as a named student; signing in and joining a class is required for that context.
The Service, including its features, functionality, software, and original content, is owned by Timothy Calford, operating as CalfordMath, and is protected by copyright, trademark, and other intellectual property laws.
Some content within the Service, such as certain photographs, may be sourced from third-party providers (such as Unsplash) under their respective licenses. Where third-party content is used, proper attribution is provided (for example, via hover-hyperlinks to the original author's page). Such third-party content remains the property of its respective owners and is used in accordance with their licensing terms.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for educational purposes.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We acknowledge that software applications may contain bugs and errors. We commit to fixing bugs to the best of our ability in a timely fashion. However, we do not guarantee that the Service will be:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
Guest preview progress may be lost if you do not sign in and transfer it, if you clear your browser session or site data, if your guest session ends, or when we delete inactive guest preview data in accordance with our Privacy Statement. We do not guarantee recovery of guest preview data.
Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid us for your current year's subscription to the Service. For users with free accounts (including students and trial accounts), our liability is limited to zero dollars ($0).
You acknowledge that the Service is an educational tool and should not be the sole basis for critical assessments or evaluations. We recommend that teachers use the Service as a supplement to, rather than a replacement for, traditional assessment methods.
You agree to indemnify, defend, and hold harmless Timothy Calford, operating as CalfordMath, and his agents and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:
You may stop using the Service at any time. If you have a paid subscription, cancellation will take effect at the end of your current billing period.
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice, for any reason, including but not limited to:
Upon termination, your right to use the Service will immediately cease. We may delete your account and data associated with your account, subject to our data retention policies and applicable law.
Guest preview access ends when your guest session ends, when you sign in and complete the conversion flow, when we suspend or remove preview access, or when guest preview data is removed under our retention practices. Guest preview data is not governed by the same account deletion process as registered users unless you sign in and obtain an account.
We reserve the right to modify these Terms at any time. We will notify users of material changes by:
Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service.
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Statement, constitute the entire agreement between you and Timothy Calford, operating as CalfordMath, regarding the use of the Service and supersede all prior agreements and understandings.
